Raila Odinga ordered by court to declare participation in election

It was a legal challenge by Raila Odinga that prompted the Supreme Court to nullify the results of the August 8 election, won by incumbent Uhuru Kenyatta, citing irregularities.

In a party statement, Odinga's National Super Alliance said that Jubilee had "no intention of competing on a level playing field" and slammed the IEBC.

The decision was announced by its leader and former Prime Minister, Raila Odinga, on Tuesday afternoon.

"There was very little room for manoeuvre here - just 60 days in which an election had to be held", he said.

But lawyers for President Uhuru Kenyatta are pointing to regulations that say if there are only two candidates and one drops out after nominations, the remaining candidate is the victor.

"All indications are that the election scheduled for 26 October will be worse than the previous one", Odinga said.

Kenyatta said he is ready for the election because he is sure that Kenyans will rally behind him as they did in the August 8 election that was nullified by the Supreme Court.

"I am now hearing that he has withdrawn from the presidential race after taking us in circles when Ksh12 billion has been allocated for preparations of the repeat election".

"Kenyans must be allowed to move on".

"We have no problem going back to elections".

It was not immediately clear whether the election will go ahead or whether Kenyatta will automatically be declared president.

He said the commission had "stonewalled meaningful deliberations" on reforms to ensure the election is credible, and warned that the upcoming vote could be more badly run than the first one.

Odinga among other demands wants Al Ghurair, the firm that has been contracted to print the papers, to be dropped because it has connections to President Uhuru Kenyatta's family.

"It is my democratic right not to participate in a pre-rigged election", Odinga told journalists.

Odinga, meanwhile, reiterated he would boycott the October 26 rerun if his demands for electoral reform were not met.

A majority found so many irregularities, they said the elections did not meet the threshold set out by the constitution.

"But Odinga says that the IEBC has refused to even listen to the some of the demands - demands that the NASA coalition says are reasonable - that they have been making".
