Federal judge blocks Trump's trans military ban

The judge, Colleen Kollar-Kotelly, issued a preliminary injunction on Monday halting two portions of Trump's presidential memorandum issued in late August, including his reinstatement of the ban on transgender service members that was in place before June 2016.

District Court Judge Colleen Kollar-Kotelly issued a preliminary injunction on the ban, ordering that the military can not keep transgender people out of the ranks and that it must continue to provide medical care for them.

In August, Trump said he planned to reverse a 2016 policy, which allowed trans troops to serve openly in the USA military.

Trump's directive reversed those policies by indefinitely extending the ban on transgender recruits and by requiring the military to oust transgender service members no later than March 23, 2018.

The Trump administration can still appeal the decision, which is a likely next step.

The service members asserted that Mr Trump's policy violated their rights to due process and equal protection under the law under the US Constitution. He followed with an August memo directing the Pentagon to extend indefinitely a ban on transgender individuals joining the military, and gave Defense Secretary Jim Mattis six months to come up with a policy on "how to address" those who are now serving.

Minter said the new court ruling means they will be able to enlist as of that date.

However, she did not block the portion of the memo directing that government funds may not be used for sex reassignment procedures.

Kollar-Kotelly didn't rule on the use of government resources to pay for sex reassignment surgeries for service members because the plaintiffs had not shown they would be impacted by it.

Kollar-Kotelly said the plaintiffs clearly established that they would be harmed by the administration's directives.

The directives "do not appear to be supported by any facts", the judge wrote.

The new administration announced in June a six-month delay on implementing that ruling, then, in July, Trump surprised Pentagon leaders by announcing on Twitter a full ban on transgender people serving "in any capacity".

The lawsuit against the president's order was filed by five transgender service members in August, citing the uncertainty that surrounded their future careers.

According to the estimates, 1,320 15,000 transgender people serve in the us army's 1.3 million active-duty personnel.
