Oral arguments on Ezekiel Elliott motion will be heard on Thursday

RB Ezekiel Elliott Again Preparing For

FRISCO, Texas - Unlike last week the Dallas Cowboys will have running back Ezekiel Elliott at practice on Wednesday and Thursday with the 2nd U.S. Circuit Court of Appeals hearing Elliott's appeal, but his status for Sunday's game against the Atlanta Falcons is not certain.

Elliott told reporters that he hasn't ever considered accepting his suspension because "it's bigger than football."

Elliott's lawyers and the NFL Players Association could ask for further litigation if the decision does not go in their favor.

If he Faila's ruling is upheld, then Elliott will be suspended immediately. Elliott was not charged by prosecutors for an alleged assault reported to police in Columbus, Ohio, in July 2016.

On Monday, the 2nd U.S. Circuit Court of Appeals in New York City said Elliott's case was on the docket for 2 p.m. ET Thursday, Nov. 9.

The Second Circut granted him an emergency stay, pending the appeal on Friday.

A panel of federal judges will hear Elliott's request for an injunction that overturns Judge Katherine Polk Failla's ruling from last week.

Elliott received a six-game suspension on August 11 for a violation of the NFL's personal conduct policy related to domestic violence allegations by a former girlfriend.

Ultimately, this battle between the National Football League and Elliott/the NFLPA rages on and appears no closer to being resolved. The NFL planned to enforce Elliott's suspension beginning Sunday until Friday's intervention by the appeals court.
