Crytek Hates Star Citizen and Squadron 42

According to Crytek, it licensed the Cryengine to Cloud Imperium Games (CIG) at a below-market rate because CIG agreed to prominently display of its trademarks in Star Citizen, and because CIG agreed to exclusively use Cryengine. "During the negotiation of the terms of the GLA, Crytek made it clear that the game license would not cover anything more". However, that model was changed and Squadron 42 became a separate entity which means CIG are now effectively creating two AAA titles. Didn't Star Citizen move over to the Amazon-owned Lumberyard (which itself is a version of CryEngine)?

Then, in June of this year, Crytek say they sent another letter requesting bug fixes and optimisations and that so far CIG and RSI "have not made a good faith effort to provide Crytek with the promised bug fixes and optimizations to the CryEngine as a complete, compilable version".

That, Crytek claims, was in breach of its original contract with CIG, claiming that promises to promote Cryengine have been disrupted by the engine switch. This is evident in marketing material for the game, which shows lines of code belonging to none other than CryEngine 3.

It definitely looks like Crytek is right to sue, but CIG has a completely different opinion.

Picking further through the complaint from Crytek, here are the key points in the document. In a response to Polygon, a representative from the company states that Crytek's lawsuit is meritless, and that they are willing to go to court to defend their stance.

All of the above is a huge problem for CIG, partly because most of these breaches have been in full public view.

Crytek's lawsuit alleges breach of contract and copyright infringement, and seeks direct damages that it believes "substantially" exceed $75,000, along with the usual blend of punitive damages, disgorgements, and injunctions.

Having first been announced in 2015 and still not formally released yet, to say Star Citizen's development has been long and protracted would be a bit of an understatement.

The claim also goes on to include Crytek being awarded actual damages and disgorgement of CIG's profits with interest and legal fees. CIG hasn't used the CryEngine for quite some time since we switched to Amazon's Lumberyard.

Cloud Imperium Games confirmed the lawsuit in a statement to PC Gamer, where they said it was "meritless" and that the developer will be fighting "vigorously" in court over the lawsuit.
