Boeing battle with Bombardier expected to drag on despite Friday decision

Bombardier Inc. of Canada on Friday won its trade dispute with aerospace giant Boeing.

In a blow to the Trump administration and Boeing, the U.S. International Trade Commission (ITC) has ruled unanimously that Canadian manufacturer Bombardier has not sold its C-Series aircraft in the below market prices. The panel's ruling blocks a Commerce Department decision last month to impose duties of nearly 300 percent.

The trade panel's ruling is "a victory for innovation, competition, and the rule of law", Bombardier, which spent more than $6 billion to develop the C Series, said in a statement.

The U.S. -based aerospace company said it will review the commission's detailed opinions when they are released.

"The fact is that when you produce an aircraft in the USA, it's not subject to any US import tariff rules", Bombardier President Alain Bellemare said in an October news conference.

In response to the ITC ruling, Boeing said that it would continue to document any harm inflicted on itself or the aerospace USA supply chain by illegal subsidies.

Most analysts expected the ITC to side with Boeing, just as it has recently sided with USA manufacturers of solar panels and washing machines. USA -listed shares of Airbus dropped 3%, and Delta fell 3.5%, after sinking 5% Wednesday, amid fears of a price war in the airline industry.

There was jubilation last night after a USA industrial court unanimously backed plane manufacturer Bombardier against United States rivals Boeing in a long running trade dispute.

Executives at both airframers said the plan eliminated the threat of import taxes because US-made CSeries would not be subject to the duties.

In this case, the commissioners ruled to reject the determination of the Commerce Department, which under President Donald Trump has taken a new, confrontational line on many trade issues - including repeated criticisms of Canada over lumber imports and the North American Free Trade Agreement. Boeing had complained that Canada unfairly subsidized Bombardier, which could then sell the jets at prices below cost. That's a day later than originally planned because of the USA government shutdown. "Period. And there may never be one", Boeing's lawyers argued in the company's most recent official filing with the commission. "We will carry on full steam with our C series project... creating new jobs in the U.S". Its development and production represent thousands of jobs in the United States, Canada, and the United Kingdom.... The self-proclaimed leader global leader in plane manufacturing also said the ruling was a victory for the American flying public.

Boeing has said the cheap pricing in the Delta deal cascaded through the broader market, damaging its profits. "We're happy to see that the ITC came to the right decision".

The trade dispute has spilled over to Boeing's customers. Quebec invested $1 billion in 2016 for a minority stake in the C Series.

It added: "With this matter behind us, we are moving full speed ahead with finalising our partnership with Airbus".
