The "depraved mind" is a reference to the third-degree murder charge, which is described in Minnesota law as someone unintentionally causing another person's death "by perpetrating an act eminently unsafe to others and evincing a depraved mind, without regard for human life".

Damond, a 40-year-old Australian, was shot dead by by Noor after he and his partner Matthew Harrity responded to her 911 call asking officers to investigate what she believed was a sexual assault taking place in the alley behind her house.

A criminal complaint unsealed on Tuesday afternoon states that there is no evidence Noor justified his decision to use deadly force, and instead he recklessly fired his handgun. "However, justice demands accountability for those responsible for recklessly killing the fellow citizens they are sworn to protect", they said in the statement.

Noor was charged with counts of third-degree murder and second-degree manslaughter, which respectively carry sentences of up to 25 years, and up to 10 years. During the pendency of the investigation, Noor declined to give a statement to investigators in the incident that made headlines in this country and in Australia. But Freeman convened a grand jury to help him investigate because, he said, several officers weren't co-operating.

Harrity has told investigators that he was startled by a loud sound near the patrol vehicle shortly before Noor fired through the open driver's-side window, striking Damond.

While Officer Harrity cooperated with BCA investigators in the wake of Damond's death, Noor refused to share his side of the story and was not compelled to by law.

Last year, Ramsey County Attorney John Choi pressed charges against St. Anthony Police Officer Jeronimo Yanez after he killed St. Paul Public Schools cafeteria worker Philando Castile during a traffic stop.

Officer Mohamed Noor, 32, turned himself in this morning on an apprehension warrant for the two charges, and he was booked into the Hennepin County Jail subject to $500,000 bail, the Minneapolis Star Tribune reported.

Freeman said Noor exercised his Fifth Amendment right not to incriminate himself, meaning Noor hasn't done any interviews or participated in the investigation thus far.

"We've been waiting for a decision over the past eight months", Damond's neighbor Ryan Masterson said. "I ask each of you to learn from the injustice in her death", said Katherine Hamberg, Fulton resident. As they drove down a nearby alley, Damond ran up out of the darkness in her pajamas and slapped the back of the auto. It said Harrity was startled, perceived his life was in danger, pulled his gun and held it to his ribcage pointing downward.

The death of the popular neighborhood organizer and activist triggered anger and action across the community, eventually leading to the resignation of Minneapolis Police Chief Janee Harteau.

Freeman maintained Tuesday that the decision to charge Noor was his.

An attorney for a Minneapolis police officer says the officer shouldn't have been charged with a crime in the fatal shooting of an unarmed Australian woman. "We need a conviction, we want assurances that will come in a Minneapolis court".
