Lindsay Lohan loses appeal in her lawsuit against GTA5 and Rockstar Games

She tried to push the issue again in the Court of Appeals, who just shared their thoughts recently: "We conclude a computer generated image may constitute a portrait within the meaning of that law". Lohan's lawyers further claimed that a mission in GTA V - in which the player must help Lacey Jonas evade paparazzi - "contains identical events to the Plaintiff's life". She also objected to a similar depiction of a blonde woman, once shown being frisked by a police officer and in another wearing a red bikini taking a selfie with her cellphone and holding up a peace sign.

Lindsay Lohan has lost the appeal of her loss in a lawsuit against Take-Two over Grand Theft Auto V.

The judge ruled that the satirical representations of "a modern, beach-going" young woman are not enough to link with Lohan.

The ruling (PDF) did find that CG images can legally be called "portraits", but said the images in question didn't represent portraits of Lohan.

The court upheld a ruling from a lower state appeals court, which dismissed her lawsuit.

In Thursday's decision, a judge said a computer image, or avatar, may constitute a "portrait" to support an invasion of privacy claim under NY civil rights law.

In fact, in the software companies' motion to dismiss, their attorneys wrote that Lohan had a "history of misusing the legal system".

For instance, in 2010, Lohan sued E-Trade over a Super Bowl ad that featured a "milkaholic" baby named Lindsay.

Lohan's lawyer Frank A. Delle Donne did not immediately respond to a request for comment. Pitbull's lyrics stated: "So, I'm tip-toein', to keep flowin', I got it locked up, like Lindsay Lohan", and Lohan was not able to win her cases against the conservative news network or the entertainer.

By now, the former movie star is perhaps more famous for her legal run-ins than her acting credits: She's been arrested on multiple occasions for charges ranging from shoplifting and reckless driving to violating her parole.
