NY parents win legal battle to evict son, 30

Parents in US sue 30-year-old son as he refuses to move out of their house

Since he still refused to leave, his parents filed for an ejectment proceeding to end what some might call a failure to launch.

State Supreme Court Justice Donald Greenwood ruled Tuesday that Michael Rotondo must leave his parents' home in Camillus in upstate NY, reported TV station WSTM.

Christina and Mark Rotondo, the aggrieved parents moved to the Onondaga County Supreme Court to force their 30-year-old son out of the family residence after he ignored five eviction notices served to him.

In filings to the Supreme Court of New York State, Rotondo's parents sent him five written notices that date back to February, one of which asks him to remove his broken auto from their property.

The parents, living in NY, wrote another letter telling their son to find a job and even offered their son $1,110 (£841) to "find a place to stay".

Two parents in NY will finally get to know what empty nest syndrome feels like. Rotondo says he's got a game plan. although we doubt his parents will like his timeline.

According to Syracuse.com, Rotondo's parents, Christina and Mark Rotondo, listened quietly as the ruling was handed down.

Mr Rotondo told the judge there was a "common law requirement of six-month notice to quit" before a tenant was "removed through ejectment action".

Michael Rotondo, who was still living in his parents' home in NY state at that age, argued he wasn't a burden to them, saying they "don't provide laundry or food". Some adult children are working and productive but can't afford to live on their own.

"A legal enforcement procedure will be instituted immediately if you do not leave by 15 March 2018", read the second notice sent on February 13.

Rotondo said he intends to appeal.

In the 2006 Matthew McConaughey romantic comedy, the grown son's parents hire a woman to try to speed their son's exit.

"They have no obligation to provide support, he's well over the age of 21", a lawyer for Rotondo's parents had argued in court.

Rotondo's reply was simple: "No, no I don't". When asked about that further, however, he would only say: "My business is my business".
